Effective Date: October 15, 2026 Version: 1.0 Applies to: All persons who access or use the Platform.
Article 1: Introduction and Scope
1.1 This document governs every cookie and similar tracking technology used on or through the Platform, including the Site, mobile applications, seller portals, and service interfaces. It states the categories into which each technology falls, the consent each category requires, the duties of third parties whose technologies appear on the Platform, and the controls available to the User.
1.2 This document supplements the Privacy Policy. If a provision of this document conflicts with the Privacy Policy, the Privacy Policy controls for matters of general data handling and this document controls for the specific subject of tracking technologies. If a provision of this document conflicts with the terms of a program in which the User participates, the program terms control for that program. Policies and help pages explain this document; they do not amend it, and in any conflict this document prevails, except as the preceding sentences provide.
Article 2: Definitions
2.1 In this document Account: the account a person or business establishes with the Company to use the Platform.
Company: All About Pawz, LLC, a Tennessee limited liability company.
Cookie: a small text file placed on a User's device by the Platform or by a third party through the Platform, including a session cookie, which is deleted when the browser closes, and a persistent cookie, which remains for a defined period or until deleted.
Platform: the websites, applications, and services the Company operates under the name All About Pawz, including aapawz.com.
Site: aapawz.com and its subdomains.
Tracking Technology: any technology, process, or mechanism that records, identifies, or infers information about a User's device, browser, session, or behavior on the Site or across third-party sites, whether or not the technology stores data on the User's device. A pixel that reports a visit to a server is a Tracking Technology; a Cookie that records a session identifier is a Tracking Technology; a combination of device attributes used to infer identity is a Tracking Technology. A technology is classified by the function it performs, not by the name a vendor gives it.
User: any person who accesses or uses the Platform, whether or not the person holds an Account.
Article 3: Categories of Tracking Technologies
3.1 The Company shall assign every Tracking Technology used on the Platform to one of the four categories in this article before the technology is used. No Tracking Technology shall be used on the Platform without an assigned category.
3.2 Strictly Necessary Technologies. Technologies required for the basic operation of the Site, including authentication, session security, load balancing, shopping cart persistence, checkout processing, fraud prevention essential to transaction integrity, and the recording of consent preferences. Strictly Necessary Technologies cannot be disabled without impairing the core functions of the Site. No consent is required for a Strictly Necessary Technology to the extent applicable law permits, because the service the User requested cannot be provided without it.
3.3 Functional Technologies. Technologies that enable the Site to remember preferences and provide enhanced features, including language selection, currency display, regional settings, recently viewed items, and interface state. Functional Technologies are first-party, do not contribute to advertising profiles, and do not transmit data to third parties for cross-context behavioral advertising. A Functional Technology requires the User's consent in a jurisdiction whose law requires prior consent for non-essential processing.
3.4 Analytics Technologies. Technologies that collect aggregated usage data so the Company can measure Site performance, identify conversion patterns, diagnose technical failures, and improve the Platform. Analytics Technologies as used by the Company are limited to internal measurement and do not share identifiers with third parties for cross-context behavioral advertising. An Analytics Technology requires the User's consent in a jurisdiction whose law requires prior consent.
3.5 Advertising Technologies. Technologies used for cross-context behavioral advertising, including identifiers that follow behavior across the Site and third-party sites to serve targeted advertisements and measure advertising performance. Advertising Technologies carry the strictest consent requirements under this document and are subject to the User's right to opt out of the sale and sharing of personal information stated in the Privacy Policy. An Advertising Technology shall load only within the consent state the User has selected and shall not load by default in a jurisdiction that requires prior consent.
Article 4: Specific Technologies
4.1 Cookies. The Site uses session Cookies for authentication, cart persistence, and session security, and persistent Cookies for preference retention, analytics, and, where the User has consented, advertising.
4.2 Web beacons and pixel tags. The Site and Company emails use pixel tags: small, transparent graphic images: to measure page loads, email opens, campaign performance, and conversion events. A pixel tag reports to the Company or to an authorized Service Provider, as defined in the Privacy Policy.
4.3 Local and session storage. The Site uses browser local storage and session storage to cache assets, retain preferences, and improve load performance. Local and session storage are subject to the same consent requirements as Cookies of the corresponding category.
4.4 Device attributes. The Company collects combinations of device attributes, including screen resolution, installed fonts, browser version, time zone, and hardware configuration, to generate a device identifier used for fraud prevention, account security, and enforcement of the Acceptable Use Policy. Device-attribute identification is a Strictly Necessary Technology to the extent it is required for security. To the extent device attributes are used for analytics or advertising, the use is classified under the corresponding category and is subject to that category's consent requirements.
4.5 Software development kits. A mobile application operated by the Company may incorporate a third-party software development kit that collects device and usage data. Each kit is assigned to a category under Article 3 and is subject to that category's consent requirements.
Article 5: Consent
5.1 Prior consent. In a jurisdiction whose law requires prior consent before a non-essential Tracking Technology is used, the Company shall not load a Functional, Analytics, or Advertising Technology until the User has affirmatively consented. Until consent is given, only Strictly Necessary Technologies are active.
5.2 Opt-out jurisdictions. In a jurisdiction that operates on an opt-out model, the Company shall honor an opt-out election immediately upon receipt. Upon an opt-out, the corresponding category of Tracking Technologies ceases to load from the moment of the election.
5.3 Recording and withdrawal. The Company records consent per User and, where technically feasible, honors a consent state across sessions and devices where the User is authenticated. Withdrawal of consent disables the corresponding category prospectively. Withdrawal does not retroactively invalidate processing conducted before withdrawal, and it terminates further collection, sale, or sharing under the withdrawn category.
5.4 Plain-language disclosure and granularity. The consent interface describes each category in plain language by function, states what the category does, and permits the User, where applicable law requires, to accept or reject each category independently. The Company shall not condition acceptance of Functional Technologies on acceptance of Advertising Technologies.
Article 6: Third Parties and Content Provided by Others
6.1 Each third-party Tracking Technology used on the Site operates under a written contract with the Company that limits the third party's use of data collected through the Site to the contracted service. A third party that uses Site-collected data beyond the contract commits a material breach, and the Company shall treat that breach as a vendor incident requiring remediation and, where applicable, notice to affected Users.
6.2 The Company audits the Tracking Technologies used on the Site periodically to verify what technologies load, what data each collects, whether each technology respects the User's consent state, and whether each technology's actual behavior matches its disclosed category. The Company shall remove an undisclosed or incorrectly categorized technology discovered through audit and shall record the incident in its compliance records.
6.3 A Seller listing, User Content, or embedded third-party widget may carry its own Tracking Technologies. Where the Company provides the embed mechanism, the Company requires disclosure of that tracking. A Seller or User who inserts third-party code into the Site without the Company's authorization is solely responsible for the compliance of that code, and the insertion violates the Acceptable Use Policy.
6.4 No third party operating on the Site may combine Site-collected data with data from other sources to build a cross-context profile of a Site User unless the combination is expressly authorized by the User's consent and disclosed in this document.
Article 7: User Controls
7.1 The Company maintains a privacy controls interface accessible from the footer of every page of the Site. Through that interface, a User may: (a) view the categories of Tracking Technologies active for the User's session; (b) grant or withdraw consent for each category independently; (c) exercise the right to opt out of the sale and sharing of personal information; and (d) request a copy of the consent record associated with the User's Account or session.
7.2 Where technically feasible, the privacy controls interface functions without Account authentication. Where authentication is necessary to bind a consent choice to a User across devices, the interface states that limitation.
7.3 A User may employ browser-level controls, including blocking Cookies, private browsing modes, and privacy-enhancing extensions. The Site is designed to remain usable where non-essential Tracking Technologies are blocked. Blocking a Strictly Necessary Technology impairs core functions, including checkout; that impairment is the consequence of the User's election, not a defect of the Site.
7.4 The Company honors a Do Not Track signal and a Global Privacy Control signal as an opt-out election for the sale and sharing of personal information to the extent applicable law requires. Such a signal does not disable a Strictly Necessary Technology.
Article 8: Data Incidents Arising from Tracking Technologies
8.1 Where a defect in a Tracking Technology results in the unauthorized collection or disclosure of personal information, the Company shall treat the event as a data incident and shall give notice to affected Users to the extent data breach notification law requires.
Article 9: Liability
9.1 Exclusion of certain damages. To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost revenue, or loss of goodwill, arising out of or relating to this document, even if the party has been advised of the possibility of those damages.
9.2 Cap. To the fullest extent permitted by law, the Company's total liability arising out of or relating to this document shall not exceed the greater of (a) the amounts the User paid to the Company under this document in the twelve months before the event giving rise to the claim, or (b) one hundred dollars ($100).
9.3 Carve-outs. This article does not limit (a) a party's indemnification obligations under this document; (b) liability for fraud or willful misconduct; (c) amounts a party owes for Orders, fees, chargebacks, or refunds under this document; or (d) liability that cannot be limited under applicable law.
9.4 Essential purpose. The parties agree that this article allocates risk between them, that it is an essential part of the basis of their bargain, and that it applies even if a limited remedy fails of its essential purpose.
Article 10: Indemnification
10.1 Duty. The User shall indemnify, defend, and hold harmless the Company and its members, managers, employees, and agents from and against every claim, demand, action, loss, liability, judgment, settlement, cost, and expense (including reasonable attorneys' fees) arising out of or relating to: (a) the User's breach of this document; (b) Tracking Technologies or code the User or a Seller under the User's control inserts into the Site; (c) the User's violation of any law or of the rights of any person.
10.2 Procedure. The Company shall give prompt written notice of a claim under this article. The User shall control the defense with counsel reasonably acceptable to the Company. The Company may participate in the defense at its own expense. The User shall not settle a claim in a manner that imposes any obligation or restriction on the Company, or that does not release the Company fully, without the Company's prior written consent.
10.3 Survival. This article survives the termination of this document.
Article 11: Enforcement and Appeals
11.1 Investigation. The Company may investigate any suspected violation of this document. The User shall cooperate with an investigation and shall produce the records this document requires the User to keep.
11.2 Notice. If the Company determines that the User has violated this document, the Company shall give written notice stating the provision violated and the facts relied on, except where notice would compromise an investigation of fraud, a safety risk, or a legal obligation.
11.3 Opportunity to cure. Where a violation is capable of cure, the User has ten (10) business days from notice to cure it and to confirm the cure in writing. No cure period applies to fraud, counterfeiting, a risk to the safety of a person or an animal, unlawful conduct, or a violation that by its nature cannot be cured.
11.4 Measures. If a violation is established and is not cured within the period allowed, the Company may, proportionate to the violation: (a) issue a written warning; (b) remove or suppress a listing or content; (c) cancel an Order or a booking; (d) suspend the Account or a program participation, in whole or in part; (e) terminate this document and the Account; and (f) exercise any other right or remedy available under this document or at law.
11.5 Appeal. The User may appeal a measure under this article by written notice to legal@aapawz.com within thirty (30) days of the measure, stating the grounds and attaching the records relied on. The appeal is decided by a person who did not make the original decision. The Company's decision on appeal is final. A measure remains in effect during an appeal unless the Company directs otherwise in writing.
11.6 No waiver by delay. The Company's delay in acting on a violation is not a waiver of the violation or of any later violation of the same kind.
Article 12: Term and Termination
12.1 Term. This document takes effect when the User first accesses or uses the Platform and continues until terminated under this article.
12.2 Termination by the Company. The Company may terminate this document and the Account on thirty (30) days' written notice for any reason, and immediately on written notice if the User materially breaches this document, engages in fraud, or becomes ineligible to participate.
12.3 Termination by the User. The User may terminate this document on thirty (30) days' written notice to support@aapawz.com, or by closing the Account, provided the User has no Order, booking, or investigation outstanding.
12.4 Effect of termination. On termination: (a) the rights granted under this document end; (b) obligations that arose before termination: including payment, refund, chargeback, record-keeping, and indemnification obligations: survive until satisfied; and (c) the Company shall pay amounts owed, less amounts the Company may set off under this document, within thirty (30) days, except amounts held in connection with an open investigation or dispute.
12.5 Survival. The Definitions, Liability, Indemnification, Enforcement and Appeals (for measures taken before termination), Dispute Resolution, and General Provisions articles survive termination.
Article 13: Dispute Resolution
13.1 Any dispute arising out of or relating to this document, or to the relationship it governs, is governed by the Dispute Resolution Policy, which is incorporated into this document by reference.
Article 14: General Provisions
14.1 Amendments. The Company may amend this document by posting the amended document in the Document Center and giving notice to the User at the email address in the Account. An amendment that materially increases the User's fees or obligations takes effect thirty (30) days after notice; other amendments take effect on posting. Continued use of the Platform after the effective date of an amendment is acceptance of it. If the User does not accept an amendment, the User's remedy is to terminate under Article 12 before the amendment takes effect.
14.2 Notices. Legal notices under this document shall be sent to legal@aapawz.com. Operational notices, consent questions, and all other communications shall be sent to support@aapawz.com. A notice to the Company is effective when the Company acknowledges receipt or, for email, one business day after sending, whichever is earlier. Notices to the User are effective when sent to the email address in the Account or posted to the Account's notice facility in the portal, whichever occurs first. The User shall keep the email address in the Account current. DMCA notices are given as provided in the DMCA and Copyright Policy, to the designated agent at legal@aapawz.com.
14.3 Governing law. This document is governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Subject to the Dispute Resolution Policy, any proceeding arising out of this document shall be brought in the state or federal courts located in Shelby County, Tennessee, and the parties consent to personal jurisdiction there.
14.4 Severability. If any provision of this document is held unenforceable, the provision shall be enforced to the fullest extent permitted, and the remaining provisions continue in full effect.
14.5 Entire agreement. This document, together with the documents it incorporates by reference, is the entire agreement between the Company and the User for the subject it governs and supersedes every prior or contemporaneous statement, communication, or agreement on that subject, whether written or oral.
14.6 Assignment. The User shall not assign this document or any right or obligation under it without the Company's prior written consent, and an assignment without consent is void. The Company may assign this document to an affiliate or in connection with a sale of all or part of its business, on notice to the User.
14.7 Waiver. A waiver of any provision of this document is effective only in writing and only for the instance stated. No waiver is a waiver of any other provision or instance.
14.8 Interpretation. Headings are for convenience only. "Including" means "including without limitation." This document shall not be construed against a party on the ground that the party prepared it. The English-language text controls over any translation.
